It governs your use of the Sancus Africa platform, services, and any associated websites, mobile applications, or APIs (collectively referred to as the "Sancus Africa Platform").
By accessing or using the Sancus Africa Platform, you unconditionally accept and agree to be bound by the terms and conditions outlined in this Agreement, including the Privacy Policy and any applicable laws and guidelines. If you disagree with any part of this Agreement, please do not use the Sancus Africa Platform or any services. Please read this Agreement carefully.

Our Service

Sancus Digital Limited provides a range of financial technology services through the Sancus Africa platform. The services include but are not limited to:

1. Cryptocurrency Transactions: Enabling users to send, receive, buy, and sell cryptocurrencies such as Bitcoin and Ethereum using wallets hosted by Sancus Africa.
2. Refill Transactions: Enabling users to pay for bills and services (e.g., airtime, data, electricity, cable TV) via a fiat wallet hosted by Sancus Africa.

Together, these services are referred to as the Sancus Africa Services.

Eligibility

To access and use the Sancus Africa Platform and Services, you must meet the following eligibility requirements:

1. Create a valid user account on the Sancus Africa Platform.
2. Be at least 18 years old or have the legal capacity to enter into a binding contract under applicable laws.
3. If you are acting on behalf of a legal entity, you must have the authority to bind that entity to this Agreement.
4. You have not been previously restricted from using the Sancus Africa Platform or Services.
5. Your use of Sancus Africa Services complies with all applicable laws, including but not limited to laws on anti-money laundering (AML), anti-corruption, and counter-terrorist financing (CFT).

KYC Information

To use the Sancus Africa Platform, you must provide accurate, up-to-date personal information, which may include identity documents, transaction data, and technical data. Sancus Africa will handle your personal information in compliance with applicable data protection laws. Your personal information may be used for the following purposes:

• To provide services to you.
• To comply with legal and regulatory requirements.
• To secure your user account and maintain information security.
• To verify your identity and bank account details.
• To protect vital interests and provide customer service.
• To facilitate corporate reorganizations or direct marketing campaigns.

Security and Unauthorized Use

Sancus Africa is committed to ensuring the security of your data and information. However, it is important that you maintain confidentiality over your account credentials (username, password, PIN). You are solely responsible for maintaining the confidentiality of your credentials. Sancus Africa will never request your account credentials via email, SMS, phone call, or other communication methods outside the official platform. If you receive such requests, please report them immediately to support@sancus.africa.
If you suspect unauthorized access or any suspicious activity on your account, notify us immediately.

Transaction Cancellation, Modification, or Refund

1. Cryptocurrency Transactions: Once confirmed, cryptocurrency transactions are non refundable and irrevocable. You cannot cancel, modify, or reverse a cryptocurrency transaction.
2. Refill Transactions: if a refill transaction is made in error, you must contact the service provider directly for any amendments or refunds.

Always verify the transaction amount and reference numbers before confirming payments.

Payment Methods

Fiat wallets on the Sancus Africa Platform can be funded via:

• Electronic Funds Transfer (EFT)
• Mobile Money
• Card Payments (depending on the user's region)

Responsibility

Sancus Digital Limited takes full responsibility for the Sancus Africa Services, including customer service, support, and dispute resolution.

Prohibited Activities

You agree not to:

1. Violate this Agreement, any applicable laws, or any other agreements with Sancus Africa.
2. Engage in or facilitate fraudulent activities.
3. Infringe on Sancus Africa's or third parties' intellectual property rights.
4. Provide false, misleading, or inaccurate personal information.
5. Engage in suspicious activities or attempt to perform chargebacks.
6. Introduce viruses, malware, or any harmful code to the platform.
7. Act in any defamatory, harassing, or threatening manner toward Sancus Africa, its employees, agents, or users.

Termination and Restriction of Access

Sancus Africa reserves the right to terminate or restrict access to your account if we suspect that you have violated any terms of this Agreement. If we restrict access, we will notify you of the action and may allow for the restoration of access at our discretion.
We also reserve the right to terminate this Agreement or restrict access for any reason, including risk management or security concerns.

Disclaimers and Limitation of Liability

The Sancus Africa Services are provided "AS IS" and without any warranties, either express or implied. Sancus Africa does not guarantee continuous, uninterrupted access to the platform, and services may be affected by factors beyond our control.
We are not liable for any losses or damages arising from the use or inability to use the Sancus Africa platform. You acknowledge that the use of the platform is at your own risk, and Sancus Africa is not responsible for any hacking, cyberattacks or security breaches.

Rates and Fees

Before initiating any cryptocurrency transactions, you must confirm the applicable rates and fees on the Sancus Africa platform.

Changes to Terms

Sancus Africa reserves the right to change these Terms of Use at any time. Continued use of the platform constitutes your acceptance of the revised terms.
